About the firm
Munoz Digital is a Texas limited liability company that sells custom software engineering and digital infrastructure to other businesses. Clients engage us when they need a registered vendor with a physical U.S. presence, a transparent descriptor on card statements, and policies that payment processors and underwriting banks can actually read.
We work from written statements of work. Source, diagrams, and reports are delivered into the client’s own GitHub organization or cloud project. Retainers carry a contractual SLA and a named delivery lead.
Organized as Munoz Digital, LLC, SOS file 806774383. Commercial terms, invoices, and card descriptors match the legal entity.
Visa, Mastercard, American Express, and ACH wire through PCI-compliant processors. We never collect card numbers on this website.
Work product ships electronically via cloud repositories and GitHub. Milestones, acceptance, and refund windows are written, not implied.

These Terms of Service (the “Terms”) govern access to and use of the website munozdigital.net and the professional information-technology services offered by Munoz Digital, LLC (“Munoz Digital,” “we,” “us,” or “our”). By requesting a proposal, executing a statement of work, submitting a payment, or otherwise using our services, the customer (“Client,” “you”) agrees to these Terms.
Munoz Digital, LLC is a limited liability company organized under the laws of the State of Texas, United States. Texas Secretary of State file number: 806774383. Registered office: Kyle, TX 78640, United States. Primary business contact: contact@munozdigital.net. Phone: (512) 803-4934.
Charges appearing on card statements, ACH advices, or invoices will identify the merchant as “MUNOZ DIGITAL” or “MUNOZDIGITAL.NET”. If you do not recognize a charge, contact contact@munozdigital.net or (512) 803-4934 before initiating a dispute with your financial institution.
Munoz Digital provides business-to-business professional services only. These include custom software engineering, application programming interface (API) design and integration, microservices implementation, cloud and DevOps engineering, technical audits, architecture advisory, and related digital deliverables.
We do not sell consumer goods, physical products, subscriptions to the general public, or regulated financial, healthcare, gambling, or adult content. All engagements are commercial transactions between Munoz Digital and a business Client (including sole proprietors acting in a commercial capacity).
A website inquiry or package selection is a request for a proposal, not a binding order. A binding engagement exists only when (a) the parties execute a written statement of work, order form, or equivalent commercial instrument (an “SOW”), or (b) the Client pays an invoice that expressly incorporates these Terms and a defined scope.
Each SOW will describe the scope, milestones, acceptance criteria, fees, and estimated timetable. If there is a conflict between an SOW and these Terms, the SOW controls for that engagement as to commercial terms; these Terms control as to legal provisions unless the SOW expressly amends them.
Published package prices are starting fees for the corresponding base scope and are stated in United States dollars, exclusive of applicable taxes. Enterprise retainers and work outside a base package are quoted individually.
Invoices are due as stated on the invoice (typically upon booking for fixed packages, and monthly in advance for retainers). We accept Visa, Mastercard, American Express, and ACH / wire transfer through PCI-DSS compliant payment processors. Munoz Digital does not store full payment-card numbers on its systems.
Late amounts may accrue interest at 1.5% per month or the maximum rate permitted by Texas law, whichever is lower. The Client is responsible for bank fees, currency conversion, and chargeback fees caused by disputes that are not resolved in the Client’s favor.
The Client will provide timely access to systems, credentials, stakeholders, content, and decisions reasonably required to perform the services. Delays caused by the Client extend corresponding deadlines on a day-for-day basis and do not entitle the Client to a fee reduction.
The Client represents that it has authority to grant any access or licenses it provides, and that materials it furnishes do not infringe third-party rights.
Upon full payment of all amounts due for a milestone or engagement, Munoz Digital assigns to the Client all right, title, and interest in custom deliverables created specifically for that Client under the applicable SOW, excluding Pre-Existing Materials.
“Pre-Existing Materials” means tools, libraries, templates, know-how, and code Munoz Digital developed before the engagement or independently of it. Munoz Digital retains ownership of Pre-Existing Materials and grants the Client a non-exclusive, perpetual, royalty-free license to use them solely as embodied in the paid deliverables.
Until payment in full, Munoz Digital retains title to unpaid work product and may disable access to staging environments or repositories associated with unpaid invoices.
Each party will protect the other’s non-public business, technical, and personal information using at least reasonable care and will use it only to perform the engagement. Confidentiality obligations survive for three years after termination, and indefinitely for trade secrets so long as they remain trade secrets under applicable law.
Munoz Digital will perform services in a professional and workmanlike manner consistent with generally accepted practices in custom software engineering. For thirty (30) days after written acceptance of a milestone, Munoz Digital will, at no additional labor charge, correct defects that cause the deliverable to fail the written acceptance criteria in the SOW.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR AN SOW, SERVICES AND DELIVERABLES ARE PROVIDED “AS IS.” MUNOZ DIGITAL DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that software will be immune from all security threats.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNOZ DIGITAL’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO AN ENGAGEMENT WILL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY THE CLIENT TO MUNOZ DIGITAL FOR THAT ENGAGEMENT DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.
NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR LOST-PROFITS DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY, EXCEPT FOR LIABILITY ARISING FROM A PARTY’S FRAUD, WILLFUL MISCONDUCT, OR MISAPPROPRIATION OF THE OTHER PARTY’S INTELLECTUAL PROPERTY.
The Client will indemnify and hold harmless Munoz Digital and its members, officers, and contractors from claims, damages, and reasonable legal fees arising from Client materials, Client-directed implementations, or the Client’s misuse of deliverables, except to the extent caused by Munoz Digital’s gross negligence or willful misconduct.
Either party may terminate an SOW for material breach if the breach remains uncured for fourteen (14) days after written notice. Munoz Digital may suspend work if invoices remain unpaid more than ten (10) days past due.
Cancellation rights and refunds are described in the Refund & Cancellation Policy, which is incorporated into these Terms.
These Terms and any engagement are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Exclusive venue for disputes is the state or federal courts located in Hays County, Texas, except that Munoz Digital may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms by posting a revised version on this website with a new “Last updated” date. Material changes apply to new engagements and renewals after the posting date; they do not retroactively alter an SOW already in force unless the Client agrees in writing.

Identifiers and contact data you submit: name, corporate email address, company name if provided, project description, and any files or URLs you include in an inquiry.
Commercial data: invoices, package selected, payment status, last four digits of a card if returned by our processor, ACH confirmation numbers, and billing address supplied at checkout. We do not collect or store full PAN, CVV, or magnetic-stripe data.
Technical data: IP address, browser type, device type, referring URL, and pages viewed, collected through server logs and essential hosting telemetry.
Engagement data: credentials, source code, architecture diagrams, and business records you provide so we can perform contracted work. That information is processed as a service provider / processor on your instructions.
We use information to respond to inquiries, prepare proposals, perform SOWs, invoice and collect payment, provide support, improve the website, detect fraud or abuse, and meet legal, tax, and accounting obligations.
We do not sell personal information, we do not share it for cross-context behavioral advertising, and we do not use it to train third-party foundation models.
For U.S. business contacts, we process data as reasonably necessary to operate a professional-services firm: contract performance, legal compliance, and legitimate interests in serving B2B clients, securing systems, and preventing fraud. Where a state privacy statute requires a disclosed purpose limitation, the purposes in Section 3 are exclusive.
We share information only with: (a) payment processors and acquiring banks (Visa, Mastercard, American Express networks, ACH operators) to complete a transaction; (b) cloud hosting, email, repository, and accounting vendors under contract; (c) professional advisers bound by confidentiality; (d) authorities when required by law or to protect rights; and (e) a successor in a merger or asset sale, with notice where required.
Vendors are instructed to use data only to provide services to Munoz Digital or the Client.
Inquiry records are retained for up to twenty-four (24) months if no engagement follows. Contract, invoice, and tax records are retained for seven (7) years, or longer if a legal hold applies. Repository access granted by a Client is removed at the end of the engagement unless the SOW provides ongoing maintenance.
We use HTTPS with 256-bit TLS encryption in transit, access-controlled cloud storage, least-privilege credentials, and PCI-compliant processors for card data. No method of transmission or storage is perfectly secure. Report suspected vulnerabilities to contact@munozdigital.net.

If you are a resident of California, Texas, Colorado, Virginia, or another U.S. state that grants consumer privacy rights, you may request to know, access, correct, or delete personal information, or to appeal a denial, by emailing contact@munozdigital.net. We will verify the request using the email address we have on file and respond within the statutory period (typically 45 days).
We will not discriminate against you for exercising privacy rights. Because we are a B2B consultancy and do not sell personal information, a “Do Not Sell or Share” signal is honored by default: we do not sell or share.
Authorized agents may submit requests with proof of authority. We do not knowingly collect information from children under 16, and the site is not directed to children.

This Refund & Cancellation Policy applies to all professional-service purchases from Munoz Digital, LLC. It is designed so that Clients, issuing banks, and payment networks can determine when a refund is due. Card and ACH statements will show “MUNOZ DIGITAL” or “MUNOZDIGITAL.NET”.
Munoz Digital sells custom digital professional services (audits, software development, architecture, and retainers), not physical goods and not off-the-shelf boxed software. Refunds are handled against the original payment method except where a bank or processor requires otherwise.
Nothing in this Policy limits non-waivable rights under the Texas Deceptive Trade Practices Act or applicable card-network rules. This Policy is incorporated into the Terms of Service.
You may cancel a new engagement, in writing to contact@munozdigital.net, within fourteen (14) calendar days of the later of (a) the date you paid the first invoice for that engagement or (b) the date the SOW was fully signed.
If cancellation under this Section 2 is received before Munoz Digital has begun billable work (kickoff, repository access, workshops, or drafting), we will refund 100% of fees paid for that engagement, excluding third-party costs already incurred at your written request (for example, paid cloud accounts or licensed software).
If billable work has begun during the 14-day window, we will refund the unused portion after deducting (i) hours actually performed at the SOW rate or, if none is stated, a reasonable professional rate consistent with the package, and (ii) non-cancellable third-party costs. We will provide a written breakdown.
Fixed-price packages and custom SOWs are performed against written milestones. Refund treatment is as follows:
Completed and accepted milestones: amounts paid for a milestone that the Client has accepted in writing, or that is deemed accepted because the Client did not reject it with specific, written reasons within seven (7) days of delivery notice, are not refundable. Title to those deliverables passes as described in the Terms of Service.
In-progress milestones: if an engagement is cancelled after a milestone has started but before acceptance, Munoz Digital will invoice or retain only the lesser of (a) the percentage of that milestone actually completed, evidenced by work logs or repository activity, and (b) the full milestone fee. The remainder of that milestone fee, if already prepaid, is refunded.
Future, unstarted milestones: 100% of fees prepaid for milestones that have not started will be refunded within the processing period in Section 6.
The Technical Audit & Consultation package is a single milestone. After the written report is delivered, the fee is earned. If cancelled before delivery, Section 2 or the in-progress rule in this Section 3 applies, whichever yields the greater refund to the Client.
Monthly retainers may be cancelled with fourteen (14) days’ written notice to contact@munozdigital.net. The then-current month remains payable if notice is given after the month has begun. Unused prepaid hours in a cancelled future month are refunded in full. Unused hours in the current month are refunded pro rata based on remaining business days, minus hours already consumed.
Retainer SLAs, reserved capacity, and after-hours coverage end at 23:59 Central Time on the effective cancellation date.
The following are not refundable once incurred: government filing fees, domain or certificate purchases made at the Client’s request, third-party SaaS seats provisioned in the Client’s tenant, and travel booked with Client approval. Change requests that expand scope are billed separately and follow the same milestone rules.
Email contact@munozdigital.net from the corporate address used on the order with the subject “Refund Request — [invoice number or package name]”. Include the legal company name, the payment date, the last four digits of the card or the ACH trace ID, and the reason. You may also call (512) 803-4934.
We will acknowledge the request within two (2) business days and issue a written determination within five (5) business days. Approved refunds are submitted to the original payment method within five to ten (5–10) business days after approval. Card refunds may take additional time to appear depending on the issuing bank. We will send a confirmation email when the refund is submitted.
Please contact us before filing a cardholder dispute so we can resolve billing questions, including unrecognized descriptors “MUNOZ DIGITAL” or “MUNOZDIGITAL.NET”. If a chargeback is filed, we will provide the processor with the SOW, delivery records (including GitHub or cloud access logs), this Policy, and correspondence. Unwarranted chargebacks may result in suspension of remaining work.
If a charge is reversed for insufficient funds or a declined card after work has started, the Client remains responsible for earned amounts. Munoz Digital may pause delivery until the account is current.
Munoz Digital, LLC delivers professional-service work product exclusively by electronic means. We do not ship physical media, printed binders, hardware, or other tangible goods. This Policy describes how and when digital deliverables are made available to the Client.
All deliverables — including source code, infrastructure-as-code, architecture diagrams, audit reports, credentials, recordings, and documentation — are delivered electronically via one or more of the following channels, as specified in the SOW:
• Private GitHub, GitLab, or equivalent git repositories (organization or user account designated by the Client).
• Client-owned cloud projects (Amazon Web Services, Google Cloud Platform, Microsoft Azure, or similar).
• Encrypted cloud file transfer (for example, a time-limited signed URL or a shared workspace in a business file service).
• Secure email from contact@munozdigital.net for reports, invoices, and access instructions.
No USB drive, DVD, paper, or courier shipment is included in any package. If a Client later requests physical media, that is a separate, optional arrangement and is not part of standard delivery.
A milestone is delivered when Munoz Digital has (a) placed the work product in the agreed repository or cloud location, and (b) notified the Client at the corporate email on file that the materials are available, including any access instructions.
Risk of loss and the delivery clock transfer to the Client at the time of that notice. Failure by the Client to download, clone, or review materials does not delay delivery or acceptance timelines in the Refund & Cancellation Policy.
Audit reports and consultation write-ups are typically delivered as PDF plus a walkthrough call. Software is typically delivered as a tagged git commit plus a staging URL.
Unless the SOW states otherwise: Technical Audit & Consultation packages are delivered within ten (10) business days of receiving required access. Custom Software Development base packages follow the milestone dates in the SOW; each completed milestone is pushed electronically within two (2) business days of internal QA. Retainer work is delivered on a rolling basis into the Client’s repository throughout the month.
Access credentials (repository invites, IAM roles, VPN) are issued within one (1) business day after kickoff or after the Client has created the destination organization, whichever is later.
The Client must provide a GitHub (or agreed) organization, designate at least one technical contact, and accept repository invitations. If the Client cannot accept an invite, delivery may be completed by transmitting a signed archive (.zip or .tar.gz) via encrypted cloud link to the corporate email on file.
The Client is responsible for maintaining its own accounts, SSO, and employee off-boarding. Munoz Digital will remove its own deploy keys and collaborator access within ten (10) business days after the engagement ends.
If the Client loses access to delivered materials, Munoz Digital will re-transmit the last delivered version, at no charge, within ninety (90) days of original delivery, provided the request comes from an authorized email domain. After ninety days, re-delivery may be billed as a support task under a retainer or a time-and-materials quote.
The Client is responsible for complying with U.S. export-control and sanctions laws applicable to software it receives. Deliverables may not be used for unlawful surveillance, malware, or activity prohibited by the SOW.
For merchant, chargeback, or banking reviews, Munoz Digital will produce: the SOW, git commit hashes or cloud deployment timestamps, the delivery-notice email, and (where applicable) repository invitation logs. These records constitute proof that digital goods and services were delivered electronically as advertised.
